Comfort
Web Design provides web
hosting, email services and domain services. Comfort Web
Design reserves the
right to suspend or cancel any client's access to any portion or all
of Comfort Web services, when Comfort Web Design deems that the account has been used
inappropriately. Comfort Web Design reserves the right to refuse service and/or
access to its servers to anyone.
User
Policy
1. Illegal activities.
Comfort Web prohibits sites engaged in:
Illegal activities including, but not limited to, storing and/or
distributing illegal copies of copyrighted software, warez sites,
violations of copyrights and trademarks, violations of U.S. laws,
selling and/or distributing illegal contraband.
Internet abuse including, but not limited to, spamming (unsolicited
Emailing), distribution of mass emailing programs, cross-posting
messages to a large number of usenet groups, posting obscene or
inflammatory messages, threatening other Internet users, mail
bombing Internet users, running packet sniffers or port scanners,
spamming Comfort Web Design support staff. Systems abuse including, but not
limited to, use of excessive CPU resources, use of excessive disk
space, use of excessive email storage space, hacking our systems,
installing continuously running programs, such as IRC bots,
reselling CGI scripts.
2.Adult content: We
do not allow the presentation, promotion or transmission of adult,
pornographic or obscene images, text or other content. The
determination of what is "adult content" and therefore prohibited
shall be solely made by Comfort Web Design.
3.Policy Violations:
Should a policy violation occur, Comfort Web Design reserves the right to
terminate the account without notice and without any refunds. The
policy violating client will be held responsible for any damages to
Comfort Web Design , including but not limited to, Comfort Web
Design system, servers,
connectivity, reputation, business, service, network, operations, or
equipment. The policy violator may be charged a $500 clean up fee.
Web Site
Content
1.Each web site is required to
have the Comfort Web Design signature on site, if
the site designed by Comfort Web Design. No exceptions.
2. For clients maintaining their own content Comfort Web Design is not responsible for
any lost files, information, or data. Should any data need to be
recovered, there will be a charge of $100.
Comfort Web Design does not guarantee to possess the most current copy of a
client's website except where we are providing site maintenance.
Support
Free customer support is provided via email and
through 1-830-443-4614. Billing inquiries will be answered
within two business days. Client agrees not to spam support.
Comfort Web Design does not provide custom programming and
scripting, or web site consulting services as part of our
hosting

Payment
Policy and Fees
We do not charge set-up
fees on sites.
The minimum
contract period is 1 year. All services are available in one year prepayment plans.
Full payment is required
before any hosting service is rendered, which includes renewals.
All payment-due notices will be sent by electronic mail. No bills
or invoices will be sent by postal mail or fax. Prepayment is due
each anniversary (one year) following the date the
account was established.
Unlimited
package sites are given thirty (30) days and within those thirty
(30) days you may send unlimited graphics, photos, verbiage, page
set-up, etc.
After 30 days
clients will be billed on a "As requested update basis" unless other
arrangements have been agreed upon. A complete layout change is a charge of $50.00+ per page.
These annual contracts MUST stay on the server provided by Comfort
Web Design
during the contracted time. Changing servers will require a "buyout"
of the design/rights, and the contracted maintenance becomes VOID.
Per-Page Accounts
Websites that are paid for on a
"Per-Page" basis, are not subject to free text changes, search
engine submission, keyword set up and submission and basic
maintenance. All changes made to the pages are paid for al a cart.
Per Page Accounts are one-time fees, but are not out-right owned by
the client.
Payment Method
Comfort Web
Design accepts only credit
card payments (Visa, MasterCard, American Express) made
through Paypal.com or by sending Checks, Cahiers Checks and Money Orders via U.S.
Mail. (Keep in mind, making a payment through paypal will go through
faster, and will ensure a quicker response.)
Refunds
You may
cancel at anytime. If your cancellation is within in 15 days of
your annual payment, you will receive a prorated refund that is
based upon hours of work already invested into your site. Please
keep in mind that your domain name, registration fee and server fee
are never refundable - as you may continue to use our
server without our design services. ($100.00 minimum server fee) We will not refund any fees after
15 days. Refunds will be returned to you within 45-60 days of the
actual day of cancellation.
Payment must be received
or services will not be rendered. If payment is not received on
time the account will be cancelled.
Renewal
Notification and Billing Schedule
Renewal notification is
emailed to the billing contact thirty (30) days prior to the end
of the billing cycle.
If Payment is not received
via paypal.com or through the U.S. Mail BY THE DUE DATE the
account will be temporarily shut off until payment is made.
Failure to pay within the following 10 days will result in
cancellation.
Account
Reactivation
If an account is cancelled
due to client request or billing issues and the client desires to
reactivate the account, a non-refundable reactivation fee of $100.00
will be required prior to account reactivation. Accounts are
reactivated after all outstanding charges are paid, including
hosting fees, additional features, and check processing fees,
as ell as the $100.00 reactivation fee. If an
account was cancelled due to policy violation, Comfort Webs will not
reactivate the account.
Refund
Policy
If Comfort Web Designs terminates an
account due to policy violation, there will be no refund. Fees associated with additional features are non-refundable.
Identity Packages and fees paid for marketing items are never
refundable. If a contract is breeched at any time by the client,
Comfort Webs reserves the right to refuse refunds - as services have already
been rendered.
Cancellation
Comfort Web Design reserves the right to
terminate service at any time. If an account is terminated for a
policy violation there will be no refund. Comfort Web Design reserves the right
to delete the policy-violating web site content without notice.
Customers can cancel
service at any time. All account cancellations are to be requested
through the client's control panel AND via email. If the client
requests cancellation, their account will be terminated at the end
of the current billing cycle, or immediately. If the client
specifies immediate account termination, Comfort Web Design reserves the right to
delete the web site contents without notice. If an account is
cancelled due to non-payment, Comfort Webs reserves the right to delete the
web site contents without notice. Should the Comfort Web Design client decide to
keep the web site content information for re-use, the content may be
purchased at $250.00+, and the content will be forwarded to the new
server and/or web designer. Because Comfort Web Design does not have a set-up fee,
there are no exceptions to this policy. Designs must be paid for
out-right.
Indemnification
Client agrees to defend,
indemnify and hold harmless Comfort Webs against any liabilities arising out
of defective products sold to customers from Comfort Webs servers, personal
injury or property damage caused by products or services sold or
distributed from Comfort Web Design servers, any material that infringes or
allegedly infringes on the rights of a third party available from
Comfort Web servers, and any material that libels or allegedly libels a
third party available from Comfort Web servers.
Disclaimer
Comfort Web Design is not responsible
for any damages to any client's business. Comfort Web Design makes no warranties
or guarantees of any kind, expressed or implied for services that we
provide. Use of Comfort Web Design web hosting and email service is at the
client's sole risk. Comfort Web Design services are provided on an "as is, as
available" basis. Comfort Web Design does not guarantee
that our services will be uninterrupted or error free. Comfort
Web Design will
provide every effort in good faith to ensure that its services are
available to as many Internet users as possible with minimal service
interruptions. In no circumstance will
Comfort Web Design be liable for any claims resulting from the use or inability to
use Comfort Web Design's services including, but not limited to, service
interruptions, client errors, Internet connectivity problems,
miscommunications, unauthorized access to Comfort Web Design servers, InterNIC
problems, DNS caching, Internet bandwidth congestion, power
failures, vandalism, and natural disasters.
Comfort Web Designs reserves the right to revise our policies at any
time.
By sending your payment you are agreeing to the terms and conditions set
aside in our policies.
Comfort Web Designs reserves the right to refuse service to anyone at
anytime.
